The Ohio Supreme Court is being asked to weigh in on a lawsuit filed by the families of four college baseball players killed in 2007 when a charter bus plunged off a highway overpass in Atlanta.
Attorneys for the families and some of the crash survivors want the charter bus company and the driver of the bus to be covered under the school’s insurance policy.
The decision would determine coverage before the families and players file any individual claims. Two courts already have ruled that the company and its driver were not covered by the school policy and that the bus company was responsible for the driver.
Five players for the Bluffton University baseball team were killed, along with the bus driver and his wife, when the bus crashed onto a freeway.
