An Ohio appeals court says a police officer can’t sue over injuries he suffered while writing a ticket.
The decision by the 8th Ohio District Court of Appeals in Cleveland stems from a 2011 accident in which officer Jeffrey Revlock of the Richfield Police Department was struck during a traffic stop in icy conditions on Interstate 77.
Records say Revlock was writing a failure to control ticket for Hengwei Lin after an accident when Revlock was hit from behind by another driver who slid on the ice.
Revlock sued Lin for negligence, claiming his failure to control led to the accident with the other car.
The appeals court rejected this argument June 20, saying Lin could not have foreseen that Revlock would be hit by another car.
