An insurance company is off the hook in a dispute over a motorcycle wreck and an $111,000 hospital bill.
Detroit Medical Center wants to recover the costs of treating a motorcyclist who was traveling around 100 mph when he saw the bright lights of a car and lost control.
The motorcycle never struck the vehicle, but that doesn’t automatically rule out insurance benefits. Yet in this case, the Michigan appeals court says there’s no connection between the motorcyclist’s injuries and the vehicle.
The court says there’s no evidence that the biker was forced to hit the brakes and take evasive action. The three-judge panel overturned a decision by a Wayne County judge. The rider wasn’t identified in the court decision.
