Former McAlester, Okla., City Manager Randy Green was sentenced to four years and three months in prison following his conviction on federal embezzlement charges that accused him of misapplying money from the city during a time when it was receiving federal funds.
U.S. District Judge Ronald A. White also ordered Green, 53, to pay $496,405 in restitution and to serve 36 months of probation after he completes his prison sentence on five embezzlement counts that a jury found him guilty of in March.
Green faced up to 50 years in prison, or 10 years on each count. He could also be fined up to $1.25 million.
Federal prosecutors accused Green of selling his unused leave days totaling about $585,000 – almost $458,000 more than he was entitled to – in less than five years before being fired in January 2005.
Like other city employees, Green was entitled to 33 days a year in vacation and sick leave. However, the numerous contracts he submitted for council approval often indicated the council was awarding him additional leave days instead of bonuses.
Federal prosecutors said Green embezzled at least $5,000 during federal fiscal years in which the city received at least $10,000 in federal money. The federal money went into the city’s general fund, which also paid Green for the unused leave.
White ordered Green to pay $116,909 of the restitution to the city and the balance to CNA Surety Co., a bond company that provided Green’s professional bond while he was city manager.
White gave Green until Sept. 15 to report to prison. Prosecutors had asked that Green be remanded immediately.
