The Texas Department of Insurance Division of Workers’ Compensation announced that the workers’ compensation state average weekly wage for Fiscal Year 2009 is set at $750 and is effective for dates of injury from Oct. 1, 2008, through Sept. 30, 2009.
Under House Bill 7, passed by the 79th Legislature, the workers’ compensation state average weekly wage for Fiscal Year 2008 is equal to 88 percent of the average weekly wage in covered employment as computed by the Texas Workforce Commission (TWC). The workers’ compensation state average weekly wage for Fiscal Year 2008 was $712.
The workers’ compensation state average weekly wage is used to calculate maximum and minimum weekly workers’ compensation benefit amounts. A table showing maximum and minimum weekly benefit amounts for injuries that occurred on or after Jan. 1, 1991, is available on the Texas Department of Insurance Web site at http://www.tdi.state.tx.us/wc/employee/maxminbens.html.
