A woman whose 8-year-old son drowned in a Logan County pool is suing the state Division of Natural Resources.
The Charleston Gazette reports Cynthia Fite filed the lawsuit Monday in Kanawha County Circuit Court.
Her son, Austin Cliff Runyon, was attending a pool party at Chief Logan State Park last August when he apparently fell into the pool. The lawsuit alleges the pool was improperly lit and that park officials allowed the party to go on after the pool’s normal hours of operation. It also says one lifeguard was on duty.
DNR spokesman Hoy Murphy declined comment on the lawsuit Wednesday.
