A Durham bicyclist hit by a car in 2009 is asking the North Carolina Supreme Court to allow her to collect damages from the motorist who struck her.
The Herald-Sun of Durham reports that a judge overturned a jury’s decision to give Helena Safron money after she was hit by the mirror of a passing car in Orange County. Safron says she had bruises, and the blow caused her chronic back pain to get worse.
But the judge ruled the driver gave Safron enough room and she may have swerved into the car’s path.
Safron’s lawyer says if the ruling stands, drivers will no longer have to remain a safe distance from bicyclists.
The state Supreme Court hasn’t said if it will take up Safron’s case.
