The Republican-run House of Delegates held a public meeting on a proposal to change state workers’ compensation law on deliberate intent lawsuits.
The Judiciary Committee meeting took place on Wednesday in the House chamber.
The legislation would adjust payment rules from the Workers’ Compensation Fund when an injury was self-inflicted or caused by an employer.
The bill would require proof that specific unsafe work conditions broke state or federal laws or rules. Or, there must be proof the conditions breached a well-known industry or business standard intended to address those work conditions.
If government agencies investigated the incident, those reports would have to confirm the facts.
There would have to be proof that employer had actual knowledge of the unsafe work condition and its risks.
