Another couple contending their property is on an active landslide has filed a lawsuit against the owners of a private ski resort and golf community in southwestern Montana.
The Bozeman Daily Chronicle reports that Thomas Pettus and L. Cecily Hine filed the lawsuit last week in Gallatin County District Court against Spanish Peaks Holdings and the Club at Spanish Peaks.
The lawsuit contends the company engaged in fraud, negligence, negligent misrepresentation and violation of the Consumer Protection Act.
In 2012 a Gallatin County jury awarded Donald and Darla Harbaugh nearly $565,000 and Mel and Charline Harbaugh $545,000 in damages from Spanish Peaks Holdings.
The couples said they unknowingly purchased property on an active landslide.
Another lawsuit filed in May was settled out of court.
