Jury Clears New Hampshire Transportation Department in Fatal Crash

A jury says the New Hampshire Transportation Department was not responsible for a 2007 Interstate 93 crash that killed a 6-year-old boy.

A jury in Rockingham Superior Court returned the verdict following a civil trial.

A Canadian trucking company sued the state, saying it didn’t clear ice and snow off of the interstate, causing one of the firm’s drivers to lose control. Brendon Mahoney was killed when his mother’s vehicle was hit by the rig.

The company, Fidele-Tremblay Inc. of Quebec, paid the boy’s family $2.5 million and sued the state for reimbursement. The jury did not find in favor of the company.

The company alleges the road wasn’t treated properly, but the state says the truck driver was going too fast.
